Agreement to these terms

These Terms of Service (“Terms”) govern your use of tecopahotspringsandcampground.com (the “Site”) and any text messages you agree to receive from us. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

About us

The Site is owned and operated by Flippin-Hamrick, doing business as Tecopa Hot Springs & Campground(“we,” “us,” or “our”), under a 10-year concession agreement with the County of Inyo. The County of Inyo is not a party to these Terms and is not responsible for the Site.

Using the Site

You may use the Site for personal, non-commercial purposes such as learning about the campground and making reservations. You agree not to:

• use the Site in any way that violates any law or regulation;
• attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• interfere with the Site’s operation, including by introducing malware or overloading it with automated requests;
• scrape, copy, or republish Site content for commercial purposes without our written permission; or
• impersonate anyone or provide false information when contacting us or making a reservation.

Accuracy of information

We work to keep the Site accurate, but rates, availability, amenities, hours, offers, discounts, and event details can change without notice. Information on the Site is provided for general purposes and is not a guarantee of availability or price. Discounts require valid identification as described on the Site and may be verified at check-in. If information on the Site conflicts with your reservation confirmation, the confirmation controls.

Reservations & third-party services

Reservations, payments, passes, and event tickets may be handled through third-party booking, payment, or ticketing providers. Those transactions are also subject to the provider’s own terms and privacy policy, along with any reservation, cancellation, and property policies presented to you when you book. Your stay on the property is governed by the campground and hot springs rules in effect at the time of your visit.

SMS / text messaging terms

We will not share or sell subscriber information with 3rd parties for their direct marketing purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. By selecting the Check Box on The Bookings Check Out Page Guests Agree to Receive Marketing SMS. Guests may receive an SMS before/during/after their stay with us. Reply STOP to Opt-Out | Reply HELP for Assistance. Standard message and data rates may apply

• Program. Tecopa Hot Springs & Campground guest messaging. We send messages about your reservation and stay before, during, and after your visit and, if you opted in, marketing messages such as offers and news.
• Consent. You opt in by selecting the SMS consent checkbox on the booking checkout page. By opting in, you agree to receive recurring automated text messages from us at the mobile number provided. Consent is not a condition of any purchase.
• Frequency. Message frequency varies.
• Cost. Message and data rates may apply according to your mobile carrier plan.
• Opt out. Reply STOP to any message to unsubscribe. You will receive a single confirmation message and no further messages unless you opt in again.
• Help. Reply HELP for assistance, or contact us at admin@tecopahotspringsandcampground.com or (442) 453-1987.
• Carriers are not liable for delayed or undelivered messages.
• Privacy. Your mobile information is handled as described in the SMS section of our Privacy Policy. We will not share or sell your mobile information for third-party marketing purposes.

Intellectual property

The Site and its content, including text, photographs, graphics, logos, and design, are owned by us or our licensors and are protected by copyright and trademark laws. You may view and share links to Site pages for personal use, but you may not reproduce, modify, or distribute Site content without our prior written permission. TheTecopa Hot Springs & Campground name and logo may not be used without permission.

Third-party links & content

The Site links to or embeds content from third parties, such as booking and ticketing pages, maps, local businesses and attractions, and a weather widget. We do not control and are not responsible for third-party sites, content, products, or services, and a link does not mean we endorse them. Your use of third-party sites is at your own risk and subject to their terms.

Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Weather and activity information on the Site is for general reference only; conditions in the desert can change quickly, so always check current conditions and plan accordingly.

Limitation of liability

To the fullest extent permitted by law, we and our owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the Site. Our total liability for any claim arising from the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to indemnify and hold harmless Flippin-Hamrick, Tecopa Hot Springs & Campground, and their owners, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in or servingInyo County, California, and you consent to the jurisdiction of those courts. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver.

Changes to these terms

We may update these Terms from time to time by posting a new version on this page and changing the effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.
